The dilemma and solution of legal protection of personal medical information in the era of big data

  Abstract: Personal medical information is an important component of personal information, characterized by high sensitivity, high value, and stronger public welfare. In the context of the big data era, there are problems with the legal protection of personal medical information, such as unclear legal nature positioning, difficulty in defining protection models, failure of informed consent mechanisms for personal medical information, and inadequate supervision mechanisms for personal medical information. The path to improving the legal protection of personal medical information should be improved from three aspects: first, building a specialized legal protection system for personal medical information; Secondly, reshaping the principle of consent for personal medical information disclosure; Thirdly, establish and improve a mechanism for monitoring personal medical information.
